  • Horizon Asset Management v. H&R Block, (8th Cir. 2009) (affirmance of dismissal of securities fraud class action)

  • Sherwood 48 v. Sony Pictures, 2003 U.S. App. LEXIS 20106 (2d Cir. 2003) (obtained reversal of dismissal with prejudice of state law claims arising out of Sony Pictures’ digital alteration of advertisements on clients’ Times Square buildings in connection with the Spider-Man movie)

  • Computerized Thermal Imaging v. Bloomberg L.P., 312 F. 3d 1292 (10th Cir. 2002) (affirmance of dismissal of libel action against major news publisher)

  • Hart et al. v. Internet Wire, et al., 31 Media L. Rep. 1027 (2d Cir. 2002) (affirmance of dismissal of putative securities fraud class action flowing from the innocent dissemination of what turned out to be a bogus press release)

  • Filetech S.A. v. France Telecom, S.A., 304 F. 3d 180 (2d Cir. 2002) (affirmance of dismissal of antitrust claims pursuant to the Foreign Sovereign Immunities Act and the Foreign Antitrust Improvements Act)
